If you buy a Cybertruck for some reason, make sure you keep it for at least a year.
That's Tesla's rule, anyway. According to the newly published motor vehicle order agreement for the angular EV behemoth, Tesla can sue you for $50,000 if you resell the Cybertruck within a year of purchase, as spotted by Engadget. The first Cybertruck deliveries are theoretically supposed to happen on Nov. 30.
The technical fine print is that Tesla may "seek injunctive relief" to the tune of "$50,000 or the value received as consideration for the sale or transfer, whichever is greater." You can get around this by receiving written consent from Tesla itself, but it's not clear under what conditions the company will grant these exceptions. As Engadget noted, this probably has something to do with the vehicle not entering mass production until next year.
In other words, the company wants to make sure the Cybertruck only gets into the hands of people who paid for one. If that's you, just keep this in mind.

It's not a blanket ban from reselling, Tesla wants the right to buy it first at RRP minus wear and tear. If Tesla doesn't want your car, you are free to re-sell it, but you must offers it back to the original seller first, it is the point. Google "right of first refusal", it is a pretty common legal practice.

ReplyDeleteWhat is the big fuss about this clause in the Cyber Truck contracts? Every premium car brand does that and have it in their contracts. BMW, MB, Audi.. not to mention Ferrari and Lamborghini have a clause telling you can sell back only to them.

ReplyDeletePeople are outraged without understanding the reason. Doing this prevents people from buying their cars just to flip them and drive up the price. This happened with Rivian and with the Mercedes EQS. The first groups of people who were able to get their hands on them sold them for obscenely inflated prices on the private market and just screwed things up overall. Doing this prevents people from inflating price and keeps things on a level playing field.

Imagine if all the companies did this for their limited edition cars.... we could actually fricking buy Corolla GR's, Civic Type R's, C8 Vettes, Demons, Dark Horses, hell even Priuses from the dealerships that don't markup their pricing. They are out there. I wanted to buy a new Prius 5 months ago and the local dealership said they were 9 months backordered and in that time I've seen 12 brand used Priuses on marketplace and Craigslist for 1000 to 5000 markup and they all sold within 2 days. A year ago same thing with GR Corollas. Wanted to buy one and dealership said 1 year backorder. In 30 days saw 5 for sale privately 10 to 15k over. Smh.
