Elon Musk's dubious $1 million voter lottery is getting a dose of legal scrutiny, as the city of Philadelphia sues the billionaire and X owner to stop the swing state payouts.

The city's district attorney Larry Krasner is accusing Musk of trying to influence voters and running an illegal lottery, opening up the business owner to local prosecution under the state's strict lottery regulations. Krasner has asked a judge to order Musk stop the giveaway immediately, with more than 280,000 Pennsylvanians already signed up for the raffle.

The payouts come from Musk's new America PAC, created to back the presidential campaign for Donald Trump and support "constitutional values," which ostensibly include secure borders and free speech. Musk has donated more than $118 million to the PAC, eclipsing other high-dollar contributions from the likes of the DeVos family, the Winklevoss twins, former U.S. Ambassador Kelly Craft, and Jimmy John's founder James Liautaud.

Following the super pac's unveiling, Musk said he would award daily $1 million payouts to randomly-selected voters residing in swing states who signed his petition to "support the Constitutional rights to free speech and bear arms." The giveaway wasn't the first money offer from the billionaire, and many have questioned the payouts' legality under federal law. Others expressed concern about personal data privacy for those entering.

To get around finance laws, Musk has called the lottery winners "America PAC spokespeople" and refers to the six-figure offers as "paychecks," not winnings. According to the lawsuit, Musk's actions also violate consumer protection laws by allegedly favoring winners that have attended Trump rallies. The Justice Department has also warned Musk against further action under the America PAC "lottery." Trump has avoided associating with the lottery, but has called on Musk as an ally.

Musk has recently joined the Trump campaign trail in addition to his vocal support for the candidate online. A recent New York Times report alleges that Musk's motive for supporting the twice-impeached former president is to protect himself and his companies from dozens of federal probes and to maintain his billions in government contracts.

This is being done in order to push through the last scoundrels ready to carry out any order, even a criminal one, ready for any dirty work.     Until now, not a single serious Republican has spoken out in support of Trump. Only small oligarchs like Musk. Today, punks and profiteers have hijacked the party and are posing as conservatives. What kind of conservative is Musk with 10 mistresses and 20 children? Today's elections are more like an auction than a democratic election. Whoever bids the highest is the master of the country and society. He will dictate the rules of life. Today's elections are like a casino game of razzle-dazzle where there are no rules and no one knows them. Everything is used except morality, like in business.

    All this has nothing to do with conservatism; all values ​​have been replaced by racism and hatred of man. Today, two parties are fighting for the presidency: the oligarchs' party and the Democrats. The Republican Party is not participating in the elections.     DOJ Election Crimes Manual at 44: “The bribe may be anything having monetary value, including cash, liquor, lottery chances, and welfare benefits such as food stamps. Garcia, 719 F.2d at 102."

    1. Eh, “may” is sort of like gratuitously adding “alleged” when describing crimes someone is known to have committed. There have to be charges and a conviction first. Further, since the actual letter was not quoted (or, it seems, made available to CNN at all), the choice of wording was likely theirs for this exact reason.

      The funny thing is how it looks like Cards Against Humanity is getting better legal advice than Musk did here. Paying particular confirmed previously-registered voters to apologize for not having voted in the past is a much different thing. Musk could probably clean up his problem trivially by doing something similar, offering the sweepstakes only to people who were registered to vote in particular states in some past election. It’s directly or indirectly incentivizing people to go out and register now that’s illegal.

      I am also curious how the Musk version fits with “no purchase necessary” regulations on sweepstakes. Do the relevant laws only encompass direct purchase of a product or service, or would they prohibit other potential ways of delivering something of value to the sweepstakes operator?

    1. I don't know if this is a crime in Pennsylvania, but he's suing to get an injunction to get them to stop doing this immediately. That's the normal thing to do to get a court to order someone to stop doing something before going through due process (which will definitely take more than a week).

    Go and get the link to Musk's petition and go and stand in front of your state legislature and start running a draw for 20 dollars every 15 minutes to anyone who is willing to sign it so long as they are registered to vote. If people come up to you who aren't registered, send them to the site to register to vote. Put up a poster board in sharpie behind you. And don't forget to call your local newspaper to make sure you have press coverage and make sure to film it.

    And please tell me the date and time when you get arrested. Because you will get arrested.

    If you are too chicken shit to do it, then tell me why. Because if this isn't illegal you should have no issue doing it and no repercussions should come of it.

    Pardon me? WHat he did is a federal crime. Send agents and arrest him already. He's now a known foreign agent, a felony since he had not registered himself as one, who has failed to report such contact, while he has a security clearance, a separate felony. He's known publicly visibly to be engaging in election interference, a felony. He's known to have lied about the material details to illegally obtain his residency, and failed to disclose this fact when he obtained his citizenship, two separate felonies, and ones that are disqualifying for citizenship and grounds for denaturalization explicitly and subsequent deportation afterwards inherently.

    The man is a criminal, flat out, and possibly not legally a US citizen. He should have been arrested a week ago for open election interference or his unlawful acts as a foreign agent, and multiple investigations for multiple different felony acts he's likely committed since year one of arriving in this country.

    At the very least, his security clearance should have already been revoked. It is appalling that this man is openly breaking the law so flagrantly, and nothing is being done about it.

    Can someone explain to me why the US legal system "sues" people in Civil Court instead of charging them with a crime in criminal court?

    In Canada, if you engage in illegal election antics the Royal Canadian Mounted Police (RCMP) knock on your door and cart you away in handcuffs.

    Crown Counsel charges you with a crime and you go on trial.

    They don't "sue" you.

    1. First, i think they haven’t given the prize yet in Pennsylvania, so this is an attempt to stop that, by claiming they are operating an unlicensed lottery.

      Second, the offending party is a SuperPac, which is technically a political corporation that can spend money to support a political candidate with little oversight, because the Supreme Court in 2010 that spending money is a form of free speech.

  65. When this first came out I had said that I would be surprised if the DA didn’t pursue this, so I’m glad that they are doing their job. Although it’s a but unusual to start from the grounds of lottery laws and not election laws since the latter is the main issue, Im glad the DA is pursuing this because it is in fact plainly very illegal on multiple fronts. I suspect additional law suits are coming that specifically argue the legal stance of vote-buying.

  90. The Philly DA is seeking a preliminary injunction. That's the equivalent of shifting the legal system into rabbit gear. It is the quickest move they can make right now. Arrests and criminal charges could still be forthcoming, but an investigation will take time. When the Prosecution has 1 shot to take down a defendant, they don't want to use it on a half-assed investigation only for jeopardy to attach and the case to be dismissed with prejudice, or for a jury to have reasonable doubt with their argument and find the defendant not guilty.

    So, in the meantime, they file suit and seek a preliminary injunction or temporary restraining order as a sort of legal triage while they prep for bigger things. And yes, that will take time and probably won't produce anything until after the election.

If you actually hung out on a law sub, you'd know there's this thing called an injunction, where if an initial bar of proof is passed (generally, something like "lesser of likely harms across involved people in society based on what we know now", but I don't know about Pennsylvania specifically), the court can force the person to stop the lottery until it gets into court slowly later over time and figured out.

      If they refuse to follow the injunction you can put them in contempt and jail Musk for often something like 3 days at a time, renewing if he continues to not stop. He could just continue not stopping anyway until election, but it would make it wildly more likely for him to lose the case later, and probably additional PAC officers would get indicted as well for continuing while he was gone, and the next guy while that one was also in contempt, etc.

      A court could also freeze assets depending where they're holding the money and how they're distributing it.

  106. Charity sweepstakes are legal in almost all 50 states. They are not considered gambling because participants aren't required to pay an entry fee. Requiring basic personal information to enter is not considered to be a 'payment'.

    3. Actually, it kind of is, as Elon Musk discovered; he had to go through quite a few hoops because of legal barriers related to dealership laws. They tried selling direct to consumer and discovered that's essentially illegal in all 50 states due to dealership laws that American dealerships got passed to create a monopoly on car sales.

      So Musk had to go build an entire brand of dealerships and run through all the hoops to make them lawful establishments. So he actually was, I am pretty sure, for awhile at least, illegally selling Teslas in violation of dealership laws that bar direct manufacturer to consumer sales.

      This is not a federal law suit. There are suggestions that this might violate federal law. That'd be the "buy votes" part.

      The crux of this state level lawsuit is that this is... wait for it... a lottery. Per Pennsylvania law, all lotteries must be licensed and run by the state. This... does not comply with those state level laws.

      Beyond that, there are some other consumer protection stuff tossed in there as well.
